Property Assessments

Bernstein-Burkley, P.C., represents residential and commercial clients in various real estate matters. Real estate property acquisitions, sales and leasing, residential and commercial property assessment appeals, commercial real estate distressed debt matters, and landlord-tenant issues are just a few of the areas we specialize in.

While most real estate transactions involve licensed real estate brokers and agents, the purchase and sale of real estate can be challenging and often require the expertise of an attorney who routinely represents buyers and sellers in real estate transactions. From the offer through closing, Bernstein-Burkley, P.C., has the expertise and knowledge to represent buyers and sellers throughout all phases of simple and complex real estate transactions.

Assessment law requires that real estate must be valued according to its actual value. Actual value has been interpreted by the Pennsylvania courts to mean the fair market value of the property, which is the price in a competitive market a purchaser, willing but not obligated to buy, would pay an owner, willing but not obligated to sell, taking into consideration all the legal uses to which the property can be adapted and might reasonably be applied. In order to establish the market value of real estate and maintain uniform assessments, counties may use a current year market value or adopt a base year for assessment. Our attorneys can analyze your property assessment and develop the best approach to present and argue your case.

Bernstein-Burkley, P.C., has more than 50 years of experience in analyzing the value of assets and representing the clients’ interests in bankruptcy and liquidation valuations. In addition to our asset valuation experience providing a foundation for our tax assessment appeal work, it is also part of the foundation for our bankruptcy and restructuring practice. We routinely handle distressed debt matters including forbearance, restructuring and recovery actions, and navigate our business clients through the sheriff’s sale process and other foreclosure proceedings.
