Chapter 11 and Creditors’ Committees

Our Bankruptcy & Restructuring team has a wide range of experience, including providing services in liquidations and liquidating trusts, bankruptcy litigation, and corporate reorganization like Chapter 11. Our clients range from those in the healthcare industry to manufacturing to banking, and we represent debtors, lenders, secured and unsecured creditors, and creditors’ committees, among others.

Chapter 11 bankruptcy provides for the appointment of a creditors’ committee, which is formed by the U.S. Trustee. This committee is usually made up of unsecured creditors who are among the debtor’s 20 largest and who have indicated a willingness to serve on the committee. The goal of a creditors’ committee is to create a body which is “representative” of the class of unsecured creditors, and if the U.S. Trustee feels that putting together a committee larger than seven members is necessary for fair representation, they may do so.
