Representation: Lessor of Printing Equipment
Situation: Printing equipment lessor hired Bernstein and Bernstein, P.C. to recover equipment and deficient rental payments from a lessee.
Action: The law firm filed a complaint to recover the property after the lessee failed to cure the delinquency and return the leased equipment.
The Allegheny County Sheriff’s Office had been unable to serve the lessee with the lawsuit because he refused to open the door to his business to accept the papers. Bernstein and Bernstein, P.C. obtained a court order allowing the sheriff to post a copy of the complaint on the lessee’s property and to send another copy by certified mail.
Judgment was entered in favor of the lessor, and a writ of possession for the equipment was delivered to the sheriff directing him to seize the equipment and return it to the lessor. Rather than have the sheriff seize the equipment, the lessee paid the client in full.
