This presentation will explore the interplay between ethics and the use of technology in a collection practice. Discussion will cover the use of technology when contacting and investigating debtors, and the use of technology by lawyers to market themselves and their collection practice.

Equipment Leasing & Finance Association, Legal Forum Panel: What the Transactional Lawyer Needs to Know about a Customer’s Bankruptcy

DESCRIPTION: A panel of US and Canadian bankruptcy counsel answer questions transactional lawyers may have about a customer’s bankruptcy.  Issues explored will include (i) the scope of the automatic stay, (ii) how does a lease get rejected and can a  lessee reject some but not all equipment, and how does lessor get the rejected equipment back,  (iii)  what is a cramdown and  how does it impact a lessor/secured party, and (iv) can collateral or leased equipment be sold over the secured party/lessor’s objection?  Each topic will be explored in detail and, as this is designed to be a very interactive session,  the audience will be encouraged to participate and raise other issues that  ought to be addressed.
